Terms of service
Last updated: [DATE]
1. About these terms
These terms apply between Ludvig Nyström, sole trader (enskild firma), [ADDRESS] ("we"), and the company that uses nicelookingdata ("you").
You accept the terms when you create an account or start using the service. If you accept on behalf of a company, you confirm that you are entitled to do so.
The data processing agreement at /dpa and the privacy policy at /privacy form part of these terms.
2. The service is for businesses
The service is sold to businesses. Consumer law, such as the right of withdrawal, therefore does not apply. If you are a private individual, you may use the domain scan but may not buy a paid plan. [TO VERIFY: that this matches how Paddle handles buyers.]
3. What the service does
nicelookingdata shows what your analytics accounts and your website's tags actually do. The service consists of:
- Domain scan. A check of a public website's home page without login.
- Audit of connected accounts. Google Analytics 4 and Google Tag Manager.
- Reports. A report page you can save as PDF, questions to ask your agency, and a weekly email if you turn on monitoring.
During the closed beta, sign-in is by invitation only. We will update these terms before we add Search Console, Google Ads or Meta.
What each plan includes is shown at /pricing.
4. We only read
We never change anything in your account without your approval.
In the current version we change nothing at all. We only read. We ask Google for read-only access and nothing else.
If we offer changes in the future, they will work like this: we propose, you approve each change, and the change is made under your own login. We will update these terms before such a feature is introduced.
5. Your accounts and your data
You own all your accounts.
We make no claim to your accounts, your data or your content. You grant us the right to read and process the data to the extent needed to deliver the service to you.
You are responsible for having the right to connect the accounts you connect. For example, if your agency manages an account for you, you need to have access to that account yourself.
You can remove our access at any time at myaccount.google.com/permissions, or ask us to delete your account.
6. The domain scan
The domain scan only reads what is public on a website's home page. It fetches the home page and /llms.txt once each. It then loads the home page twice in a real browser: once where it accepts in the cookie banner and once where it rejects. It does not log in, fill in forms or crawl other pages. It refuses addresses that are not public.
You may not use the scan to load, attack or map websites at scale. You can run at most 10 scans per IP address per day.
The result gets its own link that you can share. It is not indexed by search engines and is deleted 30 days after the scan. Keep in mind that if you scan a website that is not yours, the result describes someone else's website.
7. Findings are monitoring, not advice
The service runs automated technical checks. A finding describes what we observed in your accounts or on your website, at a given time, based on the data we had access to.
- Not legal advice. This applies in particular to findings about consent, cookies and tracking, such as tags loading before the visitor has consented. Such findings are a signal to look closer. They are not an assessment of whether you comply with the General Data Protection Regulation, the Swedish Electronic Communications Act (lagen om elektronisk kommunikation) or guidance from the Swedish Authority for Privacy Protection (IMY). Ask a lawyer if you need a legal answer.
- Estimates are estimates. When we show what something costs, or what it hides, the figure is based on the assumptions shown next to it. The real outcome may differ.
- Questions for your agency are questions. They support a conversation. They are not a claim that the agency has done something wrong. You decide what you forward and to whom.
You are responsible for the decisions you make based on the service.
8. Prices and payment
Prices are shown at /pricing. They are stated in Swedish kronor (SEK), excluding VAT.
- Agency audit: SEK 1,990, paid once, with 30 days of access.
- Standard: SEK 990 per month.
- Agency: SEK 2,990 per month.
If you pay yearly, a year costs ten times the monthly price.
Payments are not open yet. When they open, payment will be handled by Paddle, acting as merchant of record. This means Paddle sells the plan to you, issues the receipt and invoice, and handles VAT. Paddle's own buyer terms apply to the purchase itself. [TO VERIFY: link to Paddle's current Checkout Buyer Terms.]
Plans are paid in advance.
We may change prices. We will email you at least 30 days in advance. The new price applies from the next billing period after that. You can cancel before then.
9. Month to month, no lock-in
Monthly plans have no minimum term. You can cancel at any time. [TO VERIFY: whether cancellation happens in the app or in Paddle's customer portal.]
Your plan runs until the end of the period you have paid for. After that you are not charged again.
The Agency audit is a one-off purchase. Access ends after 30 days and nothing renews.
[TO VERIFY: refund and withdrawal rules, including for a started month, a yearly plan and the one-off Agency audit. The old terms promised a refund within 14 days of the first purchase. Decide whether that should still apply.]
10. Availability and changes to the service
We do our best to keep the service running, but we promise no particular availability.
The service relies on Google's APIs. If Google changes or closes its APIs, features in the service may be affected.
We develop the service continuously and may change or remove features. If a change affects you materially, we will tell you in advance.
11. Limitation of liability
Our total liability to you is limited to the amount you paid for the service during the 12 months before the event that caused the damage. [TO VERIFY: a minimum amount for users who do not pay, or that liability for users who do not pay is zero.]
We are not liable for indirect loss, such as lost profit, lost data, advertising costs, agency or consultant costs, or administrative fines.
These limitations do not apply if we caused the damage intentionally or through gross negligence, or where mandatory law provides otherwise.
Claims must be made to us in writing within [TO VERIFY: period, for example six months] of when you discovered, or should have discovered, the damage.
12. Personal data
For the data we read in your connected accounts, your company is the controller and we are the processor. This is governed by the data processing agreement at /dpa. How we ourselves process personal data is described in the privacy policy at /privacy.
13. Intellectual property
The software, design and text of the service belong to us. You may freely use, share and forward your reports, for example to your agency or your board. On the Agency plan you may send reports under your own brand.
14. Suspension and termination by us
We may suspend or close your account if you breach these terms, misuse the service, or if security requires it. Where possible, we will warn you first and give you time to put it right.
We may also discontinue the service. We will then give you at least 30 days' notice and refund prepaid fees for any period after discontinuation.
15. Changes to these terms
We email you about changes at least 30 days before they take effect. If you keep using the service after that, the new terms apply. If you do not want that, you can cancel before then.
16. Force majeure
We are not liable for delays or failures caused by something outside our control, such as outages at Google or our hosting providers, decisions by authorities, or widespread internet disruption.
17. Governing law and disputes
Swedish law applies. Disputes are settled by the Swedish general courts. [TO VERIFY: venue, for example Stockholm District Court or the district court where Ludvig Nyström is domiciled.]
18. Contact
[CONTACT EMAIL: suggested privacy@nicelookingdata.com]. [TO VERIFY: whether a separate support address, for example hej@nicelookingdata.com, should be listed here.]
